Delivery:
Our packages are delivered by leading package services (logistics service providers).

The delivery of our products follows after your payment (receipt of payment on our bank account) and as well as by COD immediately and reliably within up to 14 days if the product does not contain any relevant different delivery time. Due to the exclusivity of the pruduct range the product delivery times may vary. The estimated delivery time (prepayment: after receipt of payment on our bank account) is listed for each product. If the delivery time exceptionally delays, we will inform you. The estimated delivery time (prepayment) took effect from the date of your positive cedited payment.

Payment:
We accept payment by prepayment, payment by COD (Cash on delivery) and payment by banktransfer. If your payment of the full invoice amount has not been positive credited to our account within 1 week (after the order date) we will have to cancel your order.

Delivery terms and conclusion of the contract:
The purchase and supply contract with the company "4U GmbH" is done by the appointment of the delivery of the goods or by the companys delivery of ordered goods to the customer. A recession from the contract of ordered goods for processing or processed is not possible, here the customer or buyer of the goods is liable in full.

Default of acceptance, other breaches of duty by the customers

(3) If the requirements of paragraph (1) are existent, the risk of accidental loss or accidental deterioration of the goods comes at the time to the customer, in which he makes default of acceptance or debitor delay.
(4) If a notice of defects from a customer proves as unjustified, so our expenses are to be calculated with a handling flat rate of EUR 49.00 EUR. Both parties remain subject to prove a greater or lesser damage.

Defects liability to consumers according to § 13 BGB
We do not have to be responsible for defects of a delivery, which we purchased from third parties and deliver unchanged to the customer. The responsibility for negligence or intent remains unaffected.

Vacation misery, replacement delivery, subject of change:
The company "4U GmbH" is not liable to supply, if the ordered goods are evacuated or no longer available. If the goods are only partially evacuated or no longer available, the company "4U GmbH" is entitled to partial delivery.

The company "4U GmbH" is authorized to deliver other products for evacuated or no longer available products, as long as these are equivalent in quality and price. Deliveries of equivalent product do not affect the validity of this contract, unless otherwise things are specific agreed.

Commodity prices:

Implementation, delivery time:
The contractual obligation of the company "4U GmbH" is deemed to be fulfilled in the moment the ordered goods are delivered to the delivery service (UPS). Delivery will be done after the credit entry of your payment on our account. If within 14 days no delivery is possible the customer will be informed by the company "4U GmbH".

Liability for transport damage:
If parts of the goods or the complete supply of goods are damaged during transport through the delivery, the company provides "4U GmbH 'replacement, if and when an injury report is submitted by the delivery service or otherwise the damage is presented in a believable manner.

Reservation of proprietary rights:
The delivered goods remain property of the company "4U GmbH" until full payment of the purchase price and the accessory charges and shipping costs.
The customer is obligated to keep the company "4U GmbH" from all third-party access to the property subject to subject (reserved goods), and in particular of enforcement measures or other seizures, and of all the goods subject to actual damage immediately. The company "4U GmbH" takes the guarantee only in accordance with the law. After delivery, the customer has a right to demand a replacement if the goods delivered are not medium type and quality. Disclaimer:
Damages claims against the company "4U GmbH" are excluded independent from the legal reason, unless the company "4U GmbH" has intentional or grossly negligent or claims for damages result from breach of the main duties.
(1) We are liable in cases of intent or gross negligence by ourselves, by an agent or agents in accordance with lawful regulations. In addition, we are only liable under the Product Liability Act, due to the hurt of life, body or health, because of culpable violation of fundamental contractual obligations, or if we fraudulently concealed the defect or a guarantee for the quality of the delivered goods have taken over. The claim for damages for the violation of fundamental contractual obligations to the contract, however, predictable damage. c) The limitation periods for claims for damages also are not effective in cases of hurts of life, body or health or freedom, for claims under the Product Liability Act, in a grossly negligent breach of duty or culpable violation of fundamental contractual obligations.
(5) The limitation period begins for all claims with the delivery.
(6) As far as in this ordinace is spoken of claims of damages, there are also entitled requirements for useless charges.
(7) Unless otherwise specified, the lawful ordinances on the limitation beginning, the end inhibition, inhibition and the rebirth of deadlines are unaffected.
(8) An amendment of the burden of proof to the detriment of the buyer is with the above regulations not connected.

Consumers have the right to cancel the conclusion of the contract within two weeks. The revocation has not to be encluded a reason and is to be send in text form (eg letter, fax, e-mail) or by returning the good(s) to the company "4U GmbH" to explain to the deadline. Consequences of revocations

In case of an effective revocation, the benefits received by each party are to be returned and possibly taken utilisation (eg interest) are to be surrendered. If you can give us back the received benefit(s) / product(s) whole or in part only in a deteriorated condition, you will be obliged to pay compensation for the value. With the surrender of goods this does not apply if the deterioration of the the goods exclusively results on their verification - as have been possible in a retail store. In addition you can avoid liability for compensation by not using the goods / product(s) like an owner and avoiding anything which reduces their value. Parcel things able for shipping are at be returned at our costs and risk.

Parcel things not able for shipping will be picked up from you.

You have to pay the reshipment costs, if the good(s) conformed to the ordered one(s), and if the price of the reshipment good(s) does not exceed an amount of 40 euros or if at a higher price of the good(s) you have not provided the money consideration or a contractually agreed partial payment at the time of revocation. Otherwise, the return is free from charges for you.

Obligations for rebate of payments have to be fulfilled by you within 30 days after sending your cancellation.

Special information according to § 312d Abs. 1 BGB:

Your right of withdrawal expires early if your contractual partner began with the execution of the service with your explicit agreement before the end of the period of your right of withdrawal or if done by himself (for example, by download, etc.).


End of the revocation notice

Place of jurisdiction:
The place of jurisdiction is Meerbusch. If the customer is a businessman or a legal person of public law, Meerbusch is deemed to be the agreed place of jurisdiction. For the contractual relations between the contracting parties to each other, the laws of Germany are effective, unless the validity of German law is impossible due to obligatory standards.

Data protection:
All personal data received from you (name, address, payment information) will exclusively be utilized to wind up and execute your order. Most deliveries are handed by the DHL to which we transmit the information necessary to make the delivery of the order.  No other company, institution, person. etc. will ever receive your data. Once the order is executed (including the payment) we keep your data for tax reasons, however they remain locked and will not be used for any other purpose. Your data will then be deleted and no record will be kept.
If however you agreed that your data remain in our files, you may at anytime check, modify, cancel or delete them..

Severability clause:
If any of the above regulations is or becomes void, the validity of the remaining regulations are unaffected.
